| JAIPUR: Observing that a person sitting at the door of the court must not be denied his rights due to the delay in adjudication, the Rajasthan Nathmal Lal Bishnoi had filed a writ in the court after he was denied recruitment as a guard in the third battalion of Border Home Guards, Bikaner, by the battalion commandant despite faring well in the medical test, which he was declared failed initially but declared passed on a re-examination done by a medical board constituted by the state government on the orders of the court. The court had though admitted the case in 1997, it came up for final hearing only on February 19, 2009. During the argument, the counsel for the state said that Nathmal was not eligible for recruitment and other relief as nearly 16 years had passed between the time the post was first advertised for in 1992 and the final hearing. The counsel contended that after such a long time, neither Nathmal was fit nor was within the permissible age limit. However, Justice Govind Mathur not only directed the state to include Nathmal in the selection list prepared for recruitment of guards in the office of the battalion commandant, third battalion, Border Home Guards, Bikaner, but also to recruit him as guard from the date other similarly selected persons were recruited. The court also said that Nathmal will be entitled to all benefits including grant of seniority, promotion, fixation of pay on notional basis, revision of pay etc. However, instead of granting full back wages for the period concerned, the court directed that a lump sum amount of Rs 1,00,000 be paid to the petitioner as arrears of wages. The court observed that Nathmal had been prompt in filing his writ petition and in fact if the battalion wanted to reject him because of crossing the age limit, it should have done when the medical re-examination was ordered way back in 1997 as even then Nathmal was beyond the permissible age limit. It is better to think for adequate reforms in justice delivery system and court management methods than to dishearten a faithful citizen litigating for protection of his rights with total belief in justice, the court said. "The judiciary and executive both are equal and independent wings of the governance under the Constitution. Thus, the errors of system are required to be shared by the state wings and not by an ordinary citizen approaching the court with all humility at his part," the court observed. "In the present case, whatever delay caused in adjudication of the writ petition is because of the system and not due to the petitioner. As such, if he satisfies the court regarding his right, then this court must extend due relief to him. The delay caused or the changed circumstances may certainly be a reason to mould or reshape the relief as per the need of the objective conditions, but not for denial of just rights," it adds. |

Real life molestation caught on camera
On New Year’s Eve, a Midday reporter Shadab Khan caught on camera a crowd of about sixty people surrounding a
young girl and her boy-friend at the Gateway of India in Mumbai. The reporter got these pictures from a height -he was atop a police post trying to capture the spirit of the revellers. As the clock struck midnight the screaming girl was pawed and manhandled by the thugs surrounding her and her boy-friend was roughly pushed aside. In the melee her dress was torn and she fell down. One doesn’t know exactly how but the couple managed to extricate themselves from
the crowd and run away. No police complaint was filed. Today, the Colaba Police is planning to undertake an investigation into the incident and has taken the pictures from the reporter.
Shadab Khan writes about how shocked he is at the incident and wonders how such a thing could happen in Mumbai. Even today the press is writing about how shocking the whole incident is. That only Delhi is supposedly notorious for this kind of public behavior.
Well, I think the press should wake up and speak to a few ladies who travel by public transport or have been caught in crowds. Only then they can shed the illusion that these things happen only in Delhi. Whether it is Mumbai, Delhi, Bangalore, Pune or Calcutta, there are always cheap sex crazy elements lying in wait to molest women. Pornography, which is now freely available on the internet has just whetted their appetite.

Medical student killed in ragging

DHARAMSALA: A Delhi Public School student who had taken admission in a medical school in Himachal Pradesh last year met with a horrible death at
the hands of seniors who are training to be doctors.
Aman Kachroo (19), who passed out of DPS International in Saket and enrolled at the Dr Rajendra Prasad Medical College, Tanda, in Kangra last August had repeatedly complained to his parents about the brutal ragging that took place on campus — often by completely drunk third-year students.
On Friday night and Saturday morning, the boy was beaten so badly that he died.
"Aman used to tell us about ragging but we never thought that it was so serious. The first-year students had complained to the college administration recently, but despite that, no steps were taken to stop ragging. We've lost our son, but many others can be saved if timely steps are taken," his aunt Indira Dhar said on Monday. She said the body was being brought to Gurgaon where the parents have been living since the family moved back to India from Tanzania. Aman's father is still a visiting faculty at the Dar-es-Salaam University.
Indira Dhar alleged that due to severe beatings at the hands of senior students, Aman sustained grievous injuries on his chest, ears and face. The hostel manager had asked the students to file a written complaint, but even then no action was taken.
That the faculty and college administration had looked away from the campus brutality was obvious. But even after the death was reported, administrators tried to pass off the death as a suicide. Only after the matter blew up and cops got involved, the principal, as a token gesture, rusticated four students suspected to be involved in the ragging.
"Preliminary investigations reveal that the victim was under extreme stress following the ragging by third-year students and had collapsed on Sunday. We were informed of the incident around 9.30 pm," Kangra SP Atul Fulelzele said. That implies that the college authorities did not call the cops for nearly an entire day after Aman died.
Virkin Dhar, the victim's cousin, said he had told her that senior students used to rag juniors after getting drunk and the same thing happened on Saturday night, when they physical assaulted freshers. "We have come to know that senior students had punched and slapped Aman, inflicting internal injuries that proved to be fatal," she said.
Himachal Pradesh government suspended the hostel warden and manager after the death became public. Terming it as an unfortunate incident, state health minister Rajiv Bindal said, "Strict action would be initiated against students who were involved in it. Police are looking into the matter and well ensure total transparency in the proceedings. An autopsy was done in-camera and in the presence of a lawyer.

JALPAIGURI: A leopard was beaten to death and its claws chopped off by villagers at Dhumkipara forest in Madarihat on Saturday evening. The
hapless animal, that had got caught in a trap laid to catch rabbits, was dumped at the Dhumkipara tea-garden. While the carcass has been sent for a post-mortem, forest officials of Jalpaiguri and Cooch Behar have launched a search for the culprits.
Around 3 am on Sunday, some villagers spotted the carcass of a leopard lying at the tea-garden. They informed the forest department which sent a team of officials immediately. It was discovered that all four claws of the animal had been chopped off. According to the divisional forest officer of Cooch Behar, the claws were chopped for the tiger's nails that are worn for good luck and health by locals.
"It seems they were not poachers. The trap had been laid to catch rabbits. Unfortunately, the leopard got trapped. But since the skin was not taken, it doesn't appear that poachers were involved. We are looking for the culprits and hope to arrest them soon," said Om Prakash, divisional forest officer (DFO).
The adult male might have strayed from the forest, said some villagers. Even though forest officials claimed it was trapped, they suspect it was caught on the fringes of the Dhumkipara forest.
In 2003, a leopard was similarly trapped by villagers at Nagrakata and beaten to death. Villagers feasted on the carcass after which several were arrested. "Leopards stray into tea-gardens and villages frequently in this area. Villagers often use rabbit traps to catch them. It seems to have happened this time as well. But this time, the animal was not only killed but its claws were chopped off, which is a worry. We must ensure that leopards are not killed for claws again," added Om Prakash.

| LUCKNOW: Congress leader Digvijay Singh on Saturday apologised for the demolition of the Babri Masjid in 1992 when the party was in power at the "We would once again like to say sorry to the nation for the demolition of the Babri Masjid as at that time the P.V. Narasimha Rao led-Congress was in power." "We would also like to clarify that we will not have any kind of association with (former Bharatiya Janata Party leader) Kalyan Singh who was the chief minister of Uttar Pradesh when the (mosque) was demolished," Singh said. Singh, Congress general secretary and in-charge of party affairs in Uttar Pradesh, was here to address a rally organised by the minority cell of the party to press the Uttar Pradesh government for utilising the funds allocated by the central government for several schemes for the minorities. Earlier in the day, he said the Bahujan Samaj Party (BSP) government in the state had a lethargic attitude in implementing central government schemes. "The central government had sanctioned Rs.1,300 crore (Rs.13 billion) to the state government for various schemes for the minorities. However, the fund has yet not been utilised and will lapse on March 31," Singh said. |
